Spotify Licensing Agreement

While the financial details surrounding the deal from Spotify and Warner Music Group have gone undisclosed, it`s undeniable that streaming is increasingly an integral part of the health of major labels. Warner Music Group`s February 6 securities and Exchange Commission filing indicates that streaming brought in a large portion of the label`s revenue for fiscal 2019. “Revenue generated by music recorded under licensing agreements with our two major digital music accounts, Apple and Spotify, `represents approximately 30% of our total revenue.`” Your agreement with us includes these terms and any additional terms you agree to, as described in the Global Agreement section below, with the exception of terms with third parties (together the “Agreements”). This may include, for example, access to the Spotify service on the basis of a gift card, free or discounted trial versions or with other services. If an offer is submitted to you for such aspects of your use, you will receive any additional agreements related to it and you may have the opportunity to agree to additional terms. Some of these additional terms can be found on the Spotify site. In the event of an irreconcilable conflict between additional terms and these terms, priority shall be given to the additional terms. A party wishing to request arbitration must first send a written message about the dispute to the other party by registered letter, Federal Express, UPS or Express Mail (signature required) or, if we have not registered a physical address for you, by e-mail (“message”). The communication (1) must describe the nature and basis of the claim or dispute; and (2) concrete remedies (“debt”). We agree to make good faith efforts to resolve the claim directly, but if we do not reach an agreement on this matter within 30 days of receiving the notice, you or Spotify may initiate arbitration proceedings.
